These Terms and Conditions govern your use of The Steel Market Victoria website and the purchase of products from us through our website, quotation process, email, telephone or other approved sales channels.

By using our website, requesting a quotation, approving an order or purchasing products from us, you agree to these Terms and Conditions.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

2. Website Use

You may use this website only for lawful purposes.

You must not:

  • Use the website for fraudulent or unlawful activity

3. Product Information

We take reasonable care to display accurate product descriptions, specifications and images.

However:

  • Product images may be illustrative

  • Colours and finishes may appear differently on screens

  • Dimensions and weights may be approximate

  • Product availability may change

  • Packaging may vary

  • Manufacturing and mill tolerances may apply

  • Minor surface, coating or colour variations may occur

Customers must confirm that the selected product, grade, dimensions, finish and quantity are suitable before approving an order.

Product information on the website does not replace engineering, design, fabrication or professional advice.

4. Quotations

A quotation is an invitation for the customer to place an order and is not automatically a binding supply agreement.

Unless otherwise stated, a quotation:

  • Is valid for the period shown

  • Applies only to the stated products and quantities

  • Is based on information supplied by the customer

  • May exclude delivery unless specifically included

  • May be subject to stock availability

  • May be withdrawn before acceptance

  • May change if specifications or quantities change

Metal prices, freight charges and supplier costs may fluctuate. A quotation that has expired may require repricing.

An order becomes binding only after we accept it and any required payment or deposit has been received.

5. Prices and GST

Unless otherwise stated, prices are expressed in Australian dollars.

Prices may be displayed as inclusive or exclusive of GST. The applicable GST treatment will be shown in the quotation, invoice or checkout.

Prices may change without notice before an order is accepted.

The customer is responsible for reviewing:

  • Product price

  • GST

  • Delivery charges

  • Cutting or processing charges

  • Packaging charges

  • Special handling costs

  • Any other stated fees

An obvious pricing, technical or typographical error does not require us to supply a product at the incorrect price. We will notify the customer and provide the option to proceed at the correct price or cancel the affected item.

6. Orders and Acceptance

Submitting an order or accepting a quotation does not guarantee supply.

We may decline or cancel an order where:

  • A product is unavailable

  • Pricing or product information is incorrect

  • Payment is not authorised

  • Fraud or unauthorised activity is suspected

  • Delivery cannot be completed safely

  • Customer specifications are incomplete

  • A supplier cannot fulfil the order

  • The order breaches these terms or applicable law

If payment has been received for an order we cannot accept, we will provide an appropriate refund.

7. Customer Specifications

The customer is responsible for checking and approving all specifications before confirming an order, including:

  • Material type

  • Steel grade or aluminium alloy

  • Thickness

  • Width and length

  • Quantity

  • Finish or coating

  • Cutting instructions

  • Fabrication requirements

  • Delivery address

  • Required date

We may rely on measurements, drawings, files and instructions supplied by the customer.

The Steel Market Victoria is not responsible for a product being unsuitable where it was supplied accurately according to incorrect, incomplete or unsuitable customer specifications, except where liability cannot lawfully be excluded.

Structural, load-bearing, regulated and safety-critical products must be specified or approved by an appropriately qualified professional.

8. Custom-Cut and Special-Order Products

Custom-cut, fabricated, processed, made-to-order and specially sourced products are produced or obtained specifically for the customer.

Once cutting, processing, fabrication or supplier ordering has commenced:

  • Changes may not be possible

  • Cancellation may not be accepted

  • Additional charges may apply to requested changes

  • Change-of-mind returns will not normally be available

Customers must carefully review all dimensions and specifications before approving custom work.

This section does not limit remedies available for faulty, damaged or incorrectly supplied products under Australian Consumer Law.

9. Manufacturing and Cutting Tolerances

Steel, aluminium and related products may be subject to reasonable manufacturing and processing tolerances.

Variations may occur in:

  • Thickness

  • Width

  • Length

  • Straightness

  • Flatness

  • Squareness

  • Weight

  • Cut dimensions

  • Surface condition

  • Colour

  • Coating

  • Angles

  • Shape

  • Edge finish

Mill scale, minor scratches, handling marks, surface variations and normal manufacturing marks are not automatically defects where they do not materially affect the intended use.

Any special tolerance, appearance or finish requirement must be provided in writing and accepted by us before the order is confirmed.

10. Payment

Payment must be made using an approved payment method.

Depending on the order, we may require:

  • Full payment before processing

  • A deposit

  • Payment before dispatch

  • Cleared funds before collection

  • Approved credit-account terms

We may delay processing, dispatch or collection until payment has cleared.

The customer is responsible for any bank, dishonour, chargeback or recovery costs reasonably incurred because of an unpaid or reversed transaction.

11. Order Changes and Cancellation

Requests to change or cancel an order must be made in writing as soon as possible.

Cancellation may not be accepted after:

  • Materials have been cut

  • Processing or fabrication has begun

  • Special products have been ordered

  • Freight has been booked

  • Products have been dispatched

  • Custom work has commenced

Where cancellation is approved, we may deduct reasonable costs already incurred, including supplier, processing, freight and administration costs.

Nothing in this section limits rights available under Australian Consumer Law.

12. Shipping and Delivery

Delivery is governed by our Shipping Policy and any conditions stated in the quotation.

Estimated delivery dates are not guaranteed unless expressly confirmed in writing.

Delivery may be affected by:

  • Stock availability

  • Processing time

  • Carrier schedules

  • Weather

  • Road conditions

  • Site access

  • Supplier delays

  • Events outside our reasonable control

The customer must provide accurate delivery details and ensure that the site is safe and accessible.

Unless otherwise agreed, the customer is responsible for providing suitable equipment and personnel to unload heavy or oversized products.

Failed delivery, waiting time, storage, return freight or redelivery charges may apply where delivery cannot be completed because of circumstances within the customer’s control.

13. Collection

Customers must wait until we confirm that an order is ready before attending for collection.

The customer is responsible for:

  • Bringing a suitable vehicle

  • Providing appropriate restraints

  • Complying with site safety requirements

  • Safely securing the products

  • Providing identification and order information

We may refuse loading where the vehicle or restraint method is unsafe or unsuitable.

14. Inspection and Claims

Customers should inspect products as soon as reasonably possible after delivery or collection.

Visible shortages, incorrect products or freight damage should be reported promptly.

Where practical, visible delivery issues should be reported within 48 hours and supported by:

  • Order or invoice number

  • Photographs

  • Delivery documentation

  • Product details

  • Description of the issue

Customers should not cut, install, alter, fabricate or use a product after identifying a possible fault or supply error without first contacting us.

15. Returns and Consumer Guarantees

Returns, refunds, replacements and claims are governed by our Refund, Returns and Claims Policy and Australian Consumer Law.

We are not required to provide a refund or exchange where the customer:

  • Changes their mind

  • Orders an incorrect product

  • Supplies incorrect measurements

  • Selects an unsuitable grade, size or finish

  • No longer requires the product

  • Finds a lower price elsewhere

Where a product fails to meet an applicable consumer guarantee, the customer may be entitled to a repair, replacement, refund or another remedy depending on the circumstances.

16. Risk and Ownership

To the extent permitted by law, risk in the products passes to the customer when:

  • Delivery is completed

  • Products are handed to the customer or their representative

  • Products are left under an approved authority-to-leave instruction

  • Products are collected by the customer or their carrier

Ownership of the products remains with The Steel Market Victoria until all amounts payable for the order have been received in cleared funds.

Until ownership passes, the customer must not sell, dispose of or create a security interest over the products without our written approval.

17. Product Suitability

The customer is responsible for determining whether a product is suitable for its intended purpose.

Any general product guidance provided by our team is based on information supplied by the customer and does not constitute:

  • Engineering advice

  • Structural certification

  • Design approval

  • Legal advice

  • Safety certification

  • A guarantee of suitability for a particular project

Customers should obtain qualified professional advice where required.

18. Warranties

Products may be covered by manufacturer warranties or consumer guarantees.

Any manufacturer warranty is subject to the manufacturer’s conditions and operates in addition to rights available under Australian Consumer Law.

A warranty or claim may not cover problems caused by:

  • Incorrect installation

  • Improper storage

  • Misuse

  • Modification

  • Incorrect fabrication

  • Incompatible materials

  • Normal wear

  • Failure to maintain protective coatings

  • Exposure outside the product specification

  • Customer-supplied design or measurement errors

19. Limitation of Liability

Nothing in these terms excludes liability that cannot lawfully be excluded.

To the extent permitted by law, The Steel Market Victoria is not liable for indirect, incidental, special or consequential loss arising from:

  • Project delays

  • Loss of production

  • Loss of revenue

  • Loss of profit

  • Contractor costs

  • Installation delays

  • Failure to obtain independent professional advice

  • Customer specification errors

  • Events outside our reasonable control

Where liability can lawfully be limited, our liability may be limited to one or more of the following:

  • Replacing the products

  • Supplying equivalent products

  • Repairing the products

  • Paying the cost of replacement

  • Paying the reasonable cost of repair

  • Refunding the affected purchase price

This clause is subject at all times to Australian Consumer Law.

20. Website Accounts

Customers are responsible for maintaining the confidentiality of account details and passwords.

You must notify us promptly if you believe an account has been accessed without permission.

We may suspend or close an account where:

  • False information is provided

  • Fraud is suspected

  • Payments remain outstanding

  • The website is misused

  • These terms are breached

21. Intellectual Property

All website content, including text, graphics, product descriptions, logos, photographs, layouts and design elements, is owned by or licensed to The Steel Market Victoria.

You must not copy, reproduce, distribute, modify or commercially use website content without prior written permission, except as permitted by law.

Product names and third-party trademarks remain the property of their respective owners.

Personal information is handled in accordance with our Privacy Policy.

By using the website or placing an order, you acknowledge that information may be shared with relevant service providers, including Shopify, payment processors, freight carriers and technology providers, where reasonably necessary to process your enquiry or order.

Use of third-party services may also be subject to their own terms and privacy policies.

24. Force Majeure

We are not responsible for a delay or failure caused by events beyond our reasonable control, including:

  • Severe weather

  • Road closures

  • Industrial action

  • Supplier failure

  • Transport disruption

  • Government restrictions

  • Utility or technology outages

  • Public health emergencies

We will take reasonable steps to notify affected customers and resume performance when reasonably possible.

25. Changes to These Terms

We may update these Terms and Conditions to reflect changes in our operations, website, products or legal obligations.

The updated terms will be published on our website with a revised “Last updated” date.

The terms applying to an order will generally be those in effect when the order is accepted, unless a change is required by law or agreed with the customer.

26. Severability

If any part of these terms is found to be invalid, unlawful or unenforceable, that part will be read down or removed to the minimum extent necessary.

The remaining terms will continue to operate.

27. Governing Law

These Terms and Conditions are governed by the laws of Victoria, Australia.

The parties submit to the jurisdiction of the courts and tribunals of Victoria and any courts entitled to hear appeals from them.

This does not prevent a customer from exercising rights available under applicable Australian consumer law.
